By accessing or using SmartLearner, including the web dashboard and Chrome Extension, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.

2. Service Description

SmartLearner is an AI-powered language learning platform that includes:

• A Chrome Extension that provides dual subtitles, word saving, and AI analysis on streaming platforms
• A web dashboard for managing saved words, taking quizzes, and tracking progress
• A spaced repetition system (SRS) for effective vocabulary retention
• AI-powered grammar analysis and contextual word explanations

3. User Accounts

When you create an account with SmartLearner, you agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use SmartLearner to:

• Violate any applicable laws or regulations
• Reverse engineer, decompile, or disassemble the extension or web application
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools or bots to interact with our services
• Redistribute, resell, or sublicense our services without written permission
• Upload malicious content or interfere with the normal operation of the service

5. Intellectual Property

The SmartLearner name, logo, Chrome Extension, web dashboard, and all associated content (including but not limited to code, design, text, and graphics) are the intellectual property of SmartLearner and are protected by copyright and other intellectual property laws.

You retain ownership of the words and learning data you create within SmartLearner. You grant us a limited license to store and process this data solely for the purpose of providing the service.

6. Subscription & Payments

SmartLearner offers free and paid subscription tiers. Paid subscriptions are billed on a recurring basis (monthly or yearly) unless cancelled before the renewal date.

Refunds are handled on a case-by-case basis. If you are not satisfied with a paid subscription, contact us within 14 days of purchase for a review.

7. Third-Party Services

SmartLearner interacts with third-party platforms and services. Your use of these services is subject to their respective terms:

• Streaming platforms (Netflix, YouTube, etc.): SmartLearner enhances your viewing experience but is not affiliated with these platforms
• Google OAuth: Authentication is provided by Google; their Privacy Policy applies to the sign-in process
• AI providers: Word analysis and translation features rely on third-party AI services

8. Disclaimer of Warranties

SmartLearner is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or free of harmful components. AI-generated content (translations, grammar analysis) may contain inaccuracies and should not be relied upon as the sole source of learning.

9. Limitation of Liability

To the maximum extent permitted by law, SmartLearner shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the service.

Our total liability for any claims arising from your use of SmartLearner shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service or our Acceptable Use policy
• Engage in fraudulent or illegal activity
• Remain inactive for an extended period (12+ months with no login)

You may delete your account at any time through the settings page. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from these terms shall be resolved in the courts of Istanbul, Turkey.

12. Changes to These Terms

We may update these Terms of Service from time to time. Material changes will be communicated via email or a prominent notice on the service. Continued use of SmartLearner after changes are posted constitutes acceptance of the revised terms.
